TERMS AND CONDITIONS OF SALE (T&Cs) – LIVE CINEMA SAS

In accordance with the provisions of Article L 441-6 of the French Commercial Code, these terms and conditions of sale are available at all times and are systematically brought to the attention of each client/user so as to enable them to place an order. Accordingly, placing an order and checking the box “I accept the terms and conditions of sale” during the payment process implies the client’s full and unreserved acceptance of these terms and conditions of sale.

 

Article 1 – Concept

 

1.1 Live Cinema is a concept halfway between an escape game and immersive theatre, operated by the company Live Cinema SAS, located at 226 rue Saint-Denis, 75002 Paris, SIRET 948 544 861 00016. These T&Cs apply to any contract for the provision of a room between Live Cinema SAS (“Live Cinema”) and participants (“USERS”), whether they initiated the booking (“BUYER”) or are simply team members.

 

1.2 They apply to all bookings, whether made via the website https://livecinema.fr or on-site with staff.

 

1.3 The contract for booking a game session is called the “CONTRACT,” and the immersive experience booked is the “GAME SESSION.”

 

1.4 Live Cinema reserves the right to modify or have modified all or part of these terms and conditions of sale, as well as the content of its WEBSITE, at its sole discretion, at any time and without notice.

 

Article 2 – Provision and Use of the Room

 

2.1 As per the game’s principle, LIVE CINEMA SAS grants USERS the right to occupy the ROOM for a maximum duration of 120 (one hundred and twenty) minutes. Occupation of the ROOM has the sole and exclusive purpose of participating in a game organized by LIVE CINEMA SAS, which must be carried out by a team of 3 to 6 people maximum.

 

2.2 USERS accept that the maximum time spent in the ROOM is 120 minutes, regardless of whether they manage to find all the clues and solve all the puzzles. This is inherent to the very principle of the game. Likewise, USERS accept that the game may end before the 120 minutes are up, particularly if they manage to find all the clues and solve all the puzzles in less than 120 minutes, without this giving rise to any adjustment or price compensation.

 

2.3 Entry is conditional upon presentation of the booking confirmation email (sent shortly after the payment process to the BUYER) and proof of identity for the BUYER.

 

2.4 The complexity of the game and its characteristics do not allow USERS under the age of 10 to participate. Minor USERS under the age of 15 must be accompanied by at least one adult. Minor USERS over the age of 15 need not be accompanied by an adult. In case of doubt about a USER’s age, LIVE CINEMA SAS reserves the right to request proof of identity and written parental authorization.

 

2.5 USERS are required to keep the ROOM and all of its equipment (non-exhaustive list: decorations, furniture, electronics, etc.) in good condition and to use it in accordance with its authorized purpose. Accordingly, the USER acknowledges under the CONTRACT that any intentional damage or damage caused by unauthorized handling of the room and its equipment will be invoiced.

 

2.6 Throughout their presence on LIVE CINEMA SAS premises, the USER agrees to behave respectably, comply with the rules, and cooperate with LIVE CINEMA SAS staff.

 

As such, LIVE CINEMA SAS tolerates no form of violence, whether verbal or physical, harassment, or intimidation toward its employees, and reserves the right to refuse access to the premises to any person whose behavior falls into these categories.

 

LIVE CINEMA SAS also reserves the right to refuse access to any person under the influence of alcohol or drugs, for safety reasons for that person and those around them. For all of the above-mentioned conditions, refusal of access does not entitle the person to any compensation or refund.

 

Given the presence of actors during the experience, USERS are strictly forbidden from making physical contact with the actors.

 

2.7 Due to the nature of the game, no recording may be made inside the ROOM. Accordingly, the use of video and/or audio recording devices (including, without limitation: mobile phones, cameras, GoPros) is strictly forbidden. Any use of such a device may result in the complete stopping of the game for the entire team, without any compensation or refund.

 

Article 3 – Prices

 

3.1 The prices charged by LIVE CINEMA SAS are indicated on the WEBSITE (on the homepage as well as in the “pricing” tab) and are also displayed at the reception of LIVE CINEMA SAS premises. They are displayed in euros (€), all taxes included, per person, for a 120-minute SESSION.

 

The price per person is set based on the number of people and the time of the session.

 

Any other service will be invoiced additionally. LIVE CINEMA SAS reserves the right to change its prices at any time.

 

Article 4 – Booking and Payment

 

4.1 The provision of the ROOM is subject to booking and prior payment. This is done by the BUYER on LIVE CINEMA SAS’s WEBSITE.

 

All bookings are made via the WEBSITE, subject to the availability shown there. A booking is firm and final only upon receipt of the booking confirmation email, which is sent to the BUYER at the end of the payment process.

 

4.2 Any booking is firm and non-refundable.

 

4.3 In certain exceptional cases, LIVE CINEMA SAS staff may make the booking on the BUYER’s behalf if the BUYER is unable to make the booking themselves on the WEBSITE. In such cases, the BUYER accepts without reservation that this type of booking entails no liability whatsoever on the part of LIVE CINEMA SAS or its staff, the staff acting solely as a data-entry operator based on the instructions given by the BUYER.

 

The BUYER therefore waives any recourse arising from misuse, a breach of confidentiality of their data, or fraudulent use of their account.

 

Only credit card payments are accepted on the WEBSITE.

 

If the BUYER cannot pay the booking amount by credit card, they must come to LIVE CINEMA SAS reception to pay the amount in Euros by credit card.

 

4.4 In the event of USERS being late for a booked SESSION, LIVE CINEMA SAS may decide whether or not to start the game. In all cases, the ROOM must be vacated at the time specified in the original booking. LIVE CINEMA SAS reserves the right to refuse access to USERS who are 30 minutes or more late. Times will be systematically restated in the confirmation emails sent by LIVE CINEMA SAS.

 

4.5 If fewer USERS show up to participate in the GAME SESSION than originally planned at the time of booking, the BUYER and/or USERS may not claim a refund of the price difference.

 

4.6 The permitted limit is 6 players (USERS). LIVE CINEMA SAS reserves the right to refuse access to USERS exceeding the number of players originally planned.

 

4.7 Gift cards are valid for 18 months from the date of purchase.

 

Use on the WEBSITE: enter the confidential code shown on the card at the time of purchase and, if necessary, supplement it with your payment method.

 

Gift cards may not be exchanged, resold, refunded (even partially), credited to a card or bank account, discounted, or given as change.

 

Several codes cannot be used on the same online booking. However, they can be merged provided their combined amount does not exceed the maximum price of a game session.

 

4.8 LIVE CINEMA SAS has entrusted the management of its payment platform to a provider specializing in securing online transactions. This provider does not retain any data concerning the BUYER in its databases.

 

4.9 The WEBSITE is available in French and English versions. However, in the event of a dispute, only the French version of the WEBSITE and of the terms and conditions of sale may be enforced against LIVE CINEMA SAS.

 

A booking may not be transferred or resold for commercial purposes. If a booking is transferred or resold in violation of this article, the holder of that booking will be refused access.

 

Article 5 – Personal Data

 

5.1 The BUYER is responsible for the accuracy of the information entered on the online booking form on the WEBSITE. The information we collect about you may include: your name, email address, postal address, phone number, and date of birth.

 

Information relating to persons under 16 years of age must be provided with the consent of their legal guardian.

 

5.2 A BUYER who provides the contact details of other players/USERS (first and last names, phone numbers, email addresses) authorizes LIVE CINEMA SAS to send commercial information and offers to those individuals.

 

The BUYER and/or USER who enters their phone contact details on the WEBSITE of DEEP INSIDE SAS thereby agrees to be contacted by LIVE CINEMA SAS by phone or SMS.

 

The BUYER agrees to receive commercial information and offers from LIVE CINEMA SAS at their email address or on their mobile phone by clicking the authorization box on the WEBSITE.

 

5.3 We retain your personal data only for as long as necessary for the purposes for which it was collected, in particular to satisfy any legal or accounting requirement and any legal accountability obligation. Customer data is retained for the duration of the business relationship.

 

This data may be retained for commercial prospecting purposes for a maximum of 3 years from the end of that business relationship.

 

5.4 LIVE CINEMA SAS undertakes not to transmit its USERS’ personal data to any company outside the LIVE CINEMA SAS group.

 

5.5 LIVE CINEMA SAS may transmit your email addresses, without any associated information, to review platforms such as Trip Advisor.

 

Article 6 – Right of Withdrawal

 

6.1 In accordance with Article 221-28 of the French Consumer Code, no booking may be cancelled or refunded, except in the case of a cancellation solely attributable to LIVE CINEMA SAS. In that case, the amount of the original booking will be refunded.

 

6.2 For gift cards, and in accordance with the provisions of Article L.221-18 of the French Consumer Code, in the case of distance selling, the buyer has a 14-day withdrawal period from receipt of the gift card by the Buyer.

 

Since no return is required for electronic Gift Cards, the refund will be made within 14 days of receipt of the withdrawal request.

 

For an in-person purchase at LIVE CINEMA SAS, in the case of an on-site sale, the buyer has a 3-day withdrawal period from the date of purchase, without having to state a reason or pay a penalty, except for delivery and return costs, which remain the buyer’s responsibility in the case of a return by mail.

 

The refund will be made after verification that the corresponding gift codes have not been used.

 

6.3 In accordance with Article 121-21-8 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services (other than residential accommodation), goods transport services, car rental, catering, or leisure activities that must be provided on a specific date or during a specific period. Consequently, no booking may be cancelled or refunded, except in the case of a cancellation solely attributable to LIVE CINEMA SAS.

 

Article 7 – Safety

 

7.1 The USER agrees to comply with all safety measures given to them, whether contractual, displayed on-site, shown in an explanatory video, or given verbally by LIVE CINEMA SAS staff.

 

7.2 Smoking is strictly and formally prohibited inside the venue.

 

7.3 Each USER agrees to review and comply with the safety and fire protection instructions, as well as the emergency exits. These are clearly marked within LIVE CINEMA SAS’s premises.

 

Accordingly, it is strictly forbidden to obstruct the emergency exits, which must remain clear at all times. The USER may use the emergency exits if and only if the situation requires evacuation of the premises (e.g., a fire). Any misuse and/or unwarranted opening of these exits by one or more USER(S) will result in the invoicing of costs incurred by such misuse.

 

7.4 The USER acknowledges that it is absolutely forbidden to bring into the premises and into the ROOM items considered to be (1) physical hazards (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive), (2) hazardous to health (toxic, corrosive to skin, irritant/sensitizing, carcinogenic/teratogenic), and (3) hazardous to the aquatic environment.

 

Article 8 – Photos, Videos, and Social Media

 

8.1 Photos of each team of USERS may be taken before, after, or during the game session. These photos may be used by LIVE CINEMA SAS to populate its WEBSITE or its digital ecosystem (examples, without limitation: Facebook, Twitter, Instagram, TikTok, etc.). These same photos will be sent by email to USERS within a reasonable time after the game session.

 

8.2 LIVE CINEMA SAS cannot be held liable for any use made of the photos by USERS and/or the BUYER.

 

8.3 Each ROOM is equipped with video and audio monitoring devices enabling LIVE CINEMA SAS staff to follow the game session and guide USERS if needed. This device is solely used to support the game and does not record USERS’ game SESSIONS in any way, unless the USER requests it as part of a souvenir service offered by LIVE CINEMA SAS.

 

Article 9 – Publication of Online Reviews

 

Teams who have taken part in our experience may be invited to leave a review of their experience. LIVE CINEMA SAS reserves the right to select and publish these reviews on its website and on the following platforms where we have already collected reviews. These reviews were selected without any consideration, in order to positively showcase the room, the atmosphere, the welcome, or the sets, with the aim of selecting reviews from all types of audiences: families, escape game experts, businesses, bloggers, etc.

 

LIVE CINEMA SAS also reserves the right to select and publish reviews on other sites in the future.

 

Submitted reviews may undergo minor modifications for reasons of clarity, grammatical correction, or removal of any inappropriate content.

 

Article 10 – Mediation

 

In accordance with Article L. 152-1 of the French Consumer Code, you may make free use of the SASMEDIATIONSOLUTION mediation service, under which we fall, electronically at www.sasmediationsolution-conso.fr or by post at SASMEDIATIONSOLUTION – 222 chemin de la bergerie 01800 Saint Jean de Niost, for any complaint. Please note that recourse to mediation is only possible on the condition that your complaint has not already been examined by a judge or another mediator, and that it has already been the subject of a complaint to our Customer Service department. Mediation does not apply to disputes between professionals.

 

Article 11 – Legal Jurisdiction

 

These terms and conditions and any contract incorporating these terms are governed by French law, and all disputes are subject to the exclusive jurisdiction of the French courts.
